2. Eligibility Requirements

6. Fees, Charges & Compensation Disclosure

Our loan connecting service is provided free of charge to users. However, lenders may charge various fees and interest in connection with their loan products. These may include:

The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Any legal action or proceeding arising under these Terms that is not subject to arbitration under Section 13 shall be brought exclusively in the state or federal courts located in the State of Delaware, and you irrevocably consent to the personal jurisdiction and venue of such courts.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your relationship with taketheloan.com (including the validity, interpretation, breach, or enforceability of these Terms) shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall take place in the State of Delaware, or, at your election, in the county where you reside. The arbitrator's decision shall be final and binding.

Class Action Waiver: You and taketheloan.com agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

30-Day Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@taketheloan.com within 30 days of first accepting these Terms. Your notice must include your full name, mailing address, and a clear statement that you wish to opt out.

Exceptions: Either party may bring an individual action in small claims court. Either party may seek injunctive relief in court for intellectual property infringement.

14. Telephone & SMS Communications Consent (TCPA)

By providing your telephone number to taketheloan.com or our network of lenders, you expressly consent to receive calls and text messages — including those made or sent using an automatic telephone dialing system, an artificial or prerecorded voice, or SMS/MMS — from us, our network lenders, and our service providers, at the telephone number(s) you provide. Such communications may include loan offers, application status updates, account servicing, marketing, and customer support messages.

Consent is not a condition of any purchase or loan. Standard message and data rates may apply. Message frequency varies. You may revoke consent at any time by replying STOP to any text message, by calling the sender, or by emailing legal@taketheloan.com. For help, reply HELP. Revoking consent will not affect any loan agreement already in place between you and a lender.

15. Severability & Entire Agreement

If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving the parties' original intent.

These Terms, together with our Privacy Policy, Cookie Policy, and Responsible Lending disclosure, constitute the entire agreement between you and taketheloan.com regarding the Service and supersede all prior agreements, communications, and understandings, whether written or oral.

16. Changes to Terms

Loan offers shown on this site are extended only after a partner lender's underwriting review. Pricing and repayment terms vary by your state of residence and the lender's internal criteria, and a request through taketheloan.com does not entitle any applicant to a loan, the maximum amount displayed, or any specific rate. Additional eligibility conditions may apply.

Completing a request on taketheloan.com is an inquiry, not an application or commitment by any lender. Information you provide is forwarded to one or more partner lenders, who independently decide whether to extend an offer. Partner lenders may verify the information you submit through alternative consumer reporting agencies and may also obtain traditional credit data to assess eligibility and ability to repay. A request submitted through taketheloan.com does not, by itself, place a hard inquiry on your credit file.

Loans are not available in every state, and product availability depends on the partner lender. Short-term and small-dollar loans are intended only for unexpected, short-term cash needs and are not a substitute for long-term financial planning. A typical payday advance covers 14 to 31 days; rolling a balance over multiple cycles can substantially increase the total cost of borrowing. Late or missed payments may trigger additional fees, collection activity, and reporting to consumer agencies.
